1-hour in custody for drug user

Court Report: 22/09/2020 @ Inner London Crown Court

I’m in Courtroom 10 before Her Honour Judge Newbery for the sentencing of 19-year-old Ali Diakite of Glanville Road SW2 on two counts.

The court hears that on June 4th 2020 at around 5pm Mr Diakite was travelling as a passenger on an erratically driven moped around the Elephant and Castle.  This caught the attention of the police who pulled them over.  The defendant was found to have two bags of cannabis worth £30 and 1 bag of cocaine. 

The prosecution continues by telling the court that on June 10th 2020 the police were carrying out a drugs raid on a property on Glanville Road which just happened to be where Mr Diakite was occupying a room.

The court is told 4 bags of MDMA, 4 bags of cocaine and 3 bags of ketamine were found in his room.  Originally having been suspected of dealing these drugs, an investigation into his mobile phones revealed no evidence. 

Since being arrested we are told the defendant has been on conditional bail and has accumulated some 103 days under curfew.  It is understood two days on curfew is equivalent to one day in custody.

In passing sentence Her Honour Judge Newbery decides to pass a single sentence for all the outstanding matters.  The court hands a sentence of 1-week-custody which is deemed time served because of the accrued time from curfew.

The dock officer explains to the court that they will need some time to process the curfew-served aspect, so the defendant is taken down to the cells although he’s reassured, he’ll be released within the hour.
