“Seems to be a bit cursed this administration isn’t it” began His Honour Judge Saffman. Indeed it is. The mouseinthecourt covered an almost identical application just over a year ago at the same court in respect of the same company.
At the previous hearing, which we wrote about, HHJ Davis-White QC ordered that an administration order should take effect from 17th January 2021 for a period of 1 year.
Unfortunately, the expiry some four-weeks-ago was overlooked and the administration lapsed.
The court was told this application for a retrospective administration order was ‘relatively urgent’ as the company was expected to be wound up within the next 6 weeks and various loose ends needed to be tied up.
Explaining that “the court should exercise its discretion” the Judge said “it’s appropriate to make the order bearing in mind the administration has almost been completed and will be completed in 6 weeks or so in any event.“
An adjournment of thirty minutes was permitted to allow confirmation that secured creditor Saving Stream Security Holding Ltd had received notification of the hearing. “Service is a bit pointless if it’s served during the hearing and they can’t do anything about it” remarked the judge.
