Collateral Currie brothers trial on track as Case Management Hearing held

A six-minute-hearing in criminal proceedings brought by the FCA against the former directors of Collateral (UK) Limited was held earlier today.

Collateral purported to be a so-called Peer-to-Peer lending firm, which facilitated investments crowdfunded by members of the public.

Collateral (UK) Limited and two related companies entered administration in April 2018.

The two defendants, Andrew Currie, 57, and Peter Currie, 58, both deny two charges under the Fraud Act 2006 and one charge under the Proceeds of Crime Act 2002. The trial, with an estimated length of 4-weeks is listed to begin on April 11th 2023.

Case management hearings are subject to strict reporting restrictions. What we can say is that:

Both defendants were not required to attend, and did not.

The barristers appeared remotely over video link.
Andrew Currie was represented by Claire Robinson
Peter Currie was represented by Ashley Hendron
The FCA were represented by Stuart Biggs

His Honour Judge Perrins ordered that a further Case Management Hearing should be listed in November 2022.

Following the conclusion of the trial we can now reveal:

The judge had been shown a letter dated 12th October, asking for the hearing to be put back to 11th November.  “Is that the current position?” asked HHJ Perrins.

Stuart Biggs, on behalf of the FCA replied “exactly that“.

The judge explained to the parties that no trial judge had been allocated yet.  “Leave that with me.” he concluded.

Mouseinthecourt Comment: it is not known why the cost of three barristers, and the use of precious court time, was used on a hearing that was obviously going to be ineffective.
